Peter F. Bagley Law Office of Peter Bagley PLLC 2304 West Interstate 20 Ste. 240 Arlington, TX 76017 [Petition] [Appendix]
Question(s) presentedQUESTION PRESENTED The Fifth Circuit Court of Appeals concluded that Petitioner Joe Martin Bravo failed to identify a legally sufficient comparator and, because his Title VII claim failed that “threshold inquiry,” declined to reach his remaining arguments.! The federal circuit courts employ materially different methodologies for determining whether comparator insufficiency prevents other circumstantial evidence from receiving judicial consideration. The petition therefore asks whether failure to identify a legally sufficient comparator may become a threshold barrier to consideration of circumstantial evidence bearing on intentional discrimination. The question presented is whether Title VII and Rule 56 permit a court, after determining that a plaintiff lacks a legally sufficient comparator under a judicially developed prima facie framework, to terminate the summary judgment inquiry without considering other circumstantial evidence bearing on intentional discrimination. 1The Fifth Circuit's Opinion reads in relevant part, “Because Bravo's Title VII claim fails this threshold inquiry, we do not reach his other arguments.” Pet. App. 8, n.3.

Question(s) presentedQUESTION PRESENTED

The Nielsen Company (US), LLC offered its radio- ratings products to Cumulus Media New Holdings Inc. both bundled at a discount and on a standalone basis, at prices no one contends were below cost. The Second Circuit nonetheless held that the standalone offer was likely an unlawful “constructive tie” under Section 2 of the Sherman Act because the price was so “exorbitant” that Cumulus had “no choice” but to take the bundle. The court then affirmed a preliminary in- junction barring Nielsen from charging a “commer- cially unreasonable rate.”

The question presented is:

Whether a seller who offers its products separately and in a bundle, at prices never alleged to be below cost, may be held liable under Section 2 of the Sher- man Act for a “constructive tie” because a court deems a standalone price too high relative to a discounted bundle.
